TERMS AND CONDITIONS – COMMISSIONED ARTWORKS
1. Scope
Palma Arte offers the possibility to commission custom artworks, created upon request in collaboration with the artist.
2. Nature of the Artwork
Commissioned artworks are original, one-of-a-kind creations. The final result is subject to the artist's interpretation and may vary from any references, sketches, or images provided.
3. Creative Process
Before starting the work, the following aspects will be agreed upon:
- subject
- dimensions
- technique
- visual references (if any)
4. Quotation and Confirmation
The commission is considered confirmed upon payment of the deposit. Palma Arte reserves the right to decline requests that are not aligned with the artist's practice.
5. Payment Terms
Unless otherwise agreed:
- 50% deposit upon confirmation
- 50% balance prior to shipment
6. Production Time
Production times vary depending on the complexity of the artwork and will be communicated at the time of confirmation. Delays related to the creative process do not constitute grounds for cancellation.
7. Modifications
Modifications may be requested only during the initial stages and must be agreed upon. Requests for changes at an advanced stage may not be accepted or may incur additional costs.
8. Right of Withdrawal
Commissioned artworks are custom-made and therefore not subject to the right of withdrawal, in accordance with applicable consumer laws.
9. Cancellation and Client Satisfaction
Due to the customized and artistic nature of the work, the deposit is non-refundable. The completed artwork is not subject to subjective approval once finalized. However, Palma Arte will collaborate with the client during the initial stages to ensure the outcome aligns with the agreed expectations. In exceptional cases and at the sole discretion of the gallery, a voucher equal to the deposit amount may be issued, to be used for future purchases on the website.
10. Shipping and Delivery
Shipping will be carried out in accordance with the general Terms and Conditions of Sale.
11. Intellectual Property
The artist retains all intellectual property rights to the artwork, including reproduction and image rights. Palma Arte reserves the right to use images of the artwork for promotional purposes.
12. Acceptance
By paying the deposit, the client acknowledges and accepts these Terms and Conditions.
